These terms cover your purchase of and access to the online courses offered at couplesmassagecourses.com (the “Courses”), and any physical products we sell, by $30 Date Night Pty Ltd, an Australian company (“we”, “us”, “Melt”). Together with our Terms of Use and Privacy Policy, they form the agreement between you and us. By purchasing or accessing a Course you accept these terms. If you do not accept them, do not purchase or use the Courses.
We may update these terms. Changes take effect when posted on our website and apply to use and purchases after that date.
1. Who we are
We are an Australian company. Our contact route for anything in these terms is our contact form at couplesmassagecourses.com/contact-us
2. What Melt is, and what it is not
The Courses teach couples how to massage each other at home. They are designed for one purpose: connection, intimacy, relaxation and play between two consenting adult partners in a private home setting.
The Courses are educational and recreational content. They are made for couples in good health who want to feel good, relax and connect.
The Courses are NOT:
- medical advice, healthcare, or treatment of any kind
- massage therapy, physiotherapy or any clinical or allied health service
- designed to diagnose, treat, cure, manage or prevent any medical condition, injury or illness, and they must not be used for that purpose
- professional training. Completing a Course gives you no qualification, certification or right to massage anyone commercially or in public
- for public, commercial or workplace use of any kind
The Courses deal with adult intimacy between partners. Some content includes adult themes and may include partial nudity. By purchasing you acknowledge this and confirm you are comfortable receiving it.
You must be 18 or over to purchase or use the Courses.
3. Your account and your partner
The Courses are made for two people. Your account may be used by you and your partner in the same household. That is the intended use and we welcome it.
Your account may not be shared beyond your household, resold, or used to give any other person or business access to the Courses. Keep your password confidential. You are responsible for activity on your account. Tell us through the contact form if you believe your account has been accessed without permission.
You agree to provide accurate registration and billing information and keep it current. We may suspend or close accounts created with false information or used in breach of these terms.
4. Health and safety
We are not medical practitioners and nothing on our website or in the Courses is medical advice.
The Courses are designed for adults in good health. They are not designed for use during pregnancy, and they are not designed to treat any condition, symptom, injury or illness. If you or your partner are pregnant, have an injury, an illness or any medical condition, or you are unsure whether massage is right for you, talk to your doctor before giving or receiving any massage, and do not use the Courses as treatment.
Massage involves physical contact and physical effort. Used outside its intended purpose of relaxation, stress relief, connection and intimacy, or used contrary to the guidance in the Courses, it can cause discomfort or injury. If you or your partner feel pain or discomfort during a massage, stop immediately and see a doctor if it persists.
You are responsible for deciding whether the Courses are suitable for you and your partner, and you accept the risks of physical activity between you. Never ignore or delay medical advice because of something in the Courses.
5. Consent and conduct between partners
Every massage taught in the Courses is something two adults choose to do together. You are responsible for having your partner’s free and ongoing consent for any touch, and for respecting it when it is withdrawn.
We are not present, we are not a party to anything that happens between you and your partner, and to the fullest extent permitted by law we accept no responsibility or liability for any interaction between you and your partner or anyone else, including any interaction that goes beyond the scope described in section 2.
6. Misuse and out-of-scope use
The Courses are provided solely for the purpose in section 2: private, at-home couples massage for connection, intimacy, relaxation and play.
Any other use is misuse. Misuse includes, without limitation: using the Courses to treat a medical condition; massaging members of the public or charging anyone for massage; workplace or commercial use; use involving anyone under 18; and any non-consensual act.
To the fullest extent permitted by law, we are not liable for any loss, damage or injury arising from misuse of the Courses or from any use outside their intended purpose. You use the content at your own risk and you are solely responsible for how you apply it.
7. Your licence and our content
When you purchase a Course you get a personal, non-transferable, non-commercial licence to stream and view it for as long as your purchase or subscription entitles you.
All content in the Courses is protected by copyright and other laws. You may not copy, download (except where we provide a download), record, modify, publish, share, broadcast, sell or publicly display any Course content, and you may not bypass any security or access control. You own your access, not the content.
8. Prices, subscriptions and renewal
Prices are shown in US dollars at checkout unless stated otherwise.
Subscriptions renew automatically at the end of each billing period (monthly or yearly, as chosen at purchase) and your saved payment method is charged at renewal. We tell you the renewal price at purchase. You can cancel anytime from your account page or by contacting us, and cancelling stops the next renewal. Access continues to the end of the paid period.
Access to your purchase begins when payment is successfully processed. If you cannot access your purchase, contact us and we will fix it.
A promotional free trial may be used once per person.
9. Payment plans
Where we offer a payment plan (for example, instalments toward a Lifetime purchase), you authorise the scheduled charges to your payment method. If an instalment fails, we retry it and your access is suspended until it is paid. If it remains unpaid for 30 days, we may cancel the plan and end the access it was funding. Amounts already paid are handled under section 12 and the Australian Consumer Law.
10. Lifetime credit
From time to time we may offer subscription payments as credit toward a Lifetime purchase. Any such credit is a discretionary promotional benefit: it has no cash value, cannot be transferred or redeemed for money, applies only as described in the offer shown to you, and we may change or withdraw the program at any time for future purchases.
11. Gift certificates
Gift certificates are valid for 3 years from the date of purchase. They are redeemable for Courses on our website, are not redeemable for cash, and any unused balance after expiry is forfeited to the extent the law allows.
12. Our 30 day money back guarantee and refunds
We back the Courses with a 30 day money back guarantee. If a Course is not for you, tell us within 30 days of your first purchase of it through our contact form and we will refund what you paid for it, less any payment processing fees.
The guarantee applies to your first purchase of any Course, subscription, bundle or Lifetime purchase. It does not apply to subscription renewals, and it does not apply to physical products or shipping costs. You can stop a renewal anytime by cancelling before your renewal date.
Nothing in this section limits your rights under section 14.
13. Physical products
Where we sell physical products, we deliver them to the address you give at checkout, and risk in the product passes to you on delivery. Shipping costs are shown at checkout and are not refundable except as the law requires. Physical products are not covered by the 30 day money back guarantee, but nothing in this section affects your rights under section 14, including your rights if a product is faulty.
14. Australian Consumer Law
Our Courses and products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.
Where the law allows us to limit our liability for breach of a non-excludable guarantee, our liability is limited, at our option: for services, to supplying the services again or paying the cost of having them supplied again; and for goods, to replacing or repairing the goods or paying the cost of doing so.
15. Disclaimer
Subject to section 14, the Courses are provided as is. We do not promise they will be uninterrupted or error-free, and we make no promise about the results you or your partner will get from them. Content is provided for the purpose in section 2 and for no other purpose.
16. Limitation of liability
Subject to section 14, and to the fullest extent permitted by law, we and our directors, employees, contractors and licensors are not liable for any indirect, incidental, special, consequential or exemplary loss or damage arising from or connected with the Courses, and our total liability for any claim connected with a Course or product is limited to the amount you paid for that Course or product.
17. Indemnity
You agree to indemnify us against losses, costs and claims (including reasonable legal costs) arising from your breach of these terms or your misuse of the Courses as described in section 6, except to the extent we caused the loss.
18. Termination
We may suspend or end your access, without refund except as the law requires, if you materially breach these terms, including account sharing beyond your household, copying or redistributing content, commercial use, or providing false information. Sections 2, 4, 5, 6, 7 and 14 to 22 survive termination.
19. Changes to the Courses
We improve, add, replace and retire content over time. We may modify or discontinue any Course or feature. If we discontinue something you have an active entitlement to, your remedies are those in sections 12 and 14.
20. Privacy
Our Privacy Policy explains what personal information we collect and how we handle it.
21. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia. Nothing in this section prevents you from relying on the consumer protection laws of the place where you live.
22. General
If part of these terms is found invalid, the rest still applies. If we do not enforce a term, we have not waived it. These terms, the Terms of Use and the Privacy Policy are the entire agreement between us about the Courses.
